The defendant, Amanda Beth Schmidt, has been accused by the Grand Jury of Lake County of the following offenses: 1. Driving under the influence of intoxicants — on or about Jan. 29, in Lake County, did unlawfully drive a motor vehicle upon a highway or premises open to the public while under the influence of intoxicants, to wit: alcohol, defendant having been previously convicted of driving under the influence of intoxicants in violation of the laws of this state or another jurisdiction at least two times in the ten years prior to the date of the current offense, those convictions were as follows: on Dec. 9, 2019, Lake County case number 19CR67037; and Jan. 31, 2020, Deschutes County case number 18CR21801. 2. Reckless driving — on or about Jan. 29, in Lake County, did unlawfully and recklessly drive a vehicle upon a highway or premises open to the public in a manner that endangered the safety of persons or property.

The defendant, Tommy Alexis Seferino Luna, has been accused by the Grand Jury of Lake County of the following offenses: 1. Unauthorized use of a vehicle — on or about Oct. 20, 2020, in Lake County, did unlawfully and knowingly take, operate, ride in, exercise control over and otherwise use a vehicle, to wit: 1997 Jeep, without the consent of the owner, Stephanie Elizabeth Tinker. The State further alleges that the value of said personal vehicle is greater than $10,000. 2. Strangulation — on or about Oct. 20, 2020, in Lake County, did unlawfully and knowingly impede the normal breathing or blood circulation of Tinker by applying pressure on the throat and neck, blocking the nose or blocking the mouth of Tinker. The State further alleges that Tinker is a family or household member, as defined in ORS 135.230, of the defendant. 3. Strangulation — on or about Oct. 20, 2020, in Lake County, did unlawfully and knowingly impede the normal breathing or blood circulation of Tinker by applying pressure on the throat and neck, blocking the nose of blocking the mouth of Tinker. The State further alleges that Tinker is a family or household member, as defined in ORS 135.230, of the defendant. 4. Strangulation — on or about Oct. 20, 2020, in Lake County, did unlawfully and knowingly impede the normal breathing or blood circulation of Tinker by applying pressure on the throat and neck, blocking the nose or blocking the mouth of Tinker. The State further alleges that Tinker is a family or household member, as defined in ORS 135.230, of the defendant. 5. Menacing constituting domestic violence — on or about Oct. 20, 2020, in Lake County, did unlawfully and intentionally attempt to place Tinker in fear of imminent serious physical injury by choking her to unconsciousness. The State further alleges that this offense constituted domestic violence in that defendant and Tinker are persons cohabiting with each other.
