The defendant, Neil Edward Tubbs, has been accused by the Grand Jury of Lake County of the following offenses: 1. Rape in the first degree – on or about March 18, in Lake County did unlawfully and knowingly engage in sexual intercourse with the victim by means of forcible compulsion. 2. Strangulation – on or about March 18 in Lake County did unlawfully and knowingly impede the normal breathing or blood circulation of the victim by applying pressure on the throat and neck, blocking the noise or blocking the mouth of the victim and the victim is a family or household member, as defined in ORS 135.230, of the person. 3. Assault in the fourth degree constituting domestic violence – on or about March 18 in Lake County did unlawfully and recklessly cause physical injury to the victim. The State further alleges that this act constituted domestic violence as the victim and Tubbs are persons who have been involved in a sexually intimate relationship. 4. Menacing constituting domestic violence – on or about March 18 in Lake County did unlawfully and intentionally attempt to place the victim in fear of imminent serious physical injury by threatening her death. The State further alleges that this act constituted domestic violence as the victim and Tubbs are persons who have been involved in a sexually intimate relationship.
